Whole Family Neurofeedback Contract

This contract is between Marriage Help Colorado, PLLC, dba Whole Family Neurofeedback (WFN), (lender) and you (the borrower).

PURPOSE: This rental is to provide the borrower with a NeurOptimal® Neurofeedback training system that will permit the borrower to provide NeurOptimal® sessions to him/herself and family. The renter signing this form accepts full responsibility for the safety and return of the equipment in the same condition it was received.

Whole Family Neurofeedback reserves the right to request return of the equipment at any time. In such an event, the borrower will be refunded the unused number of days. If the borrower wishes to return the equipment prior to completion of the contract there will be no refund for unused time. The borrower may communicate with Whole Family Neurofeedback to extend the time of the rental period, if desired, and additional costs will be outlined.

Please choose one. You can add time to your rental at any point during your training. Many people begin with the Unlimited Plan and then add time as needed. Payment can be made in two installments if needed.

• Personal Plan — $599 — 12 sessions for 4 weeks. This is for individuals who plan to train at a slower pace or who need to budget their monthly costs. With this package, people usually rent for 2–3 consecutive months.
• Group Plan — $769 — 22 sessions for 4 weeks. This is for families who want a periodic boost to members' brains and central nervous systems.
• Unlimited Plan — $899 — Unlimited sessions for 4 weeks. This is for individuals and families who want to give a solid start for their brain and nervous systems where each family member generally trains for 25–30 sessions.
• Family Shared Plan — $999 — Unlimited sessions for 5 weeks. This plan works best for individuals and families who perhaps have busy lives and need more time.

Essential Notes

1. You can train as frequently or infrequently as you like. There are no minimums or maximums. NeurOptimal® does not push the brain, so you cannot over train. We encourage you to track shifts to determine a frequency that is useful or not useful to you.
2. You must connect the system to the internet weekly in order for the system to continue functioning. If you do not connect the system to wifi as instructed here, and you lose time with the system, you will not be granted additional days to the rental.
3. You must contact WFN if the system encounters difficulty in functioning. Once given instructions to fix any technical problems, if we do not hear from you in 24 hours, we will assume the system is functioning. You will not be granted additional days if you are unable to attend to the system in a timely manner.
4. Fees, completed contract, and consent form are due 24 hours prior to shipping. Acceptable forms of payment include all major credit cards.
5. One-month rental equals 28 days. Rental period starts the day after receiving the equipment. Return shipping is on the 29th day.
6. If borrower returns the system after the due date, Whole Family Neurofeedback charges a rate of $35 per day for the time overdue.
7. Failure to return the equipment within 15 business days following the termination of this contract will result in the borrower's credit card being charged WFN's replacement cost (currently $7,500 USD) as payment in full for the system. At this point, the borrower becomes a full legal owner of the license and equipment with all privileges thereto. These fees are separate and additional to the contracted rates above.
8. Regardless of how the client chooses to pay, the client must provide credit card information, so that WFN has a credit card on file for the duration of the rental period. The deposit must be paid by credit card.
9. WFN will cover shipping to and from. Please retain the return shipping label shipped with your unit.
10. Never leave the system in your car, and if flying, do not check with your luggage. You must carry through TSA with your carry on luggage.
11. There are no refunds for unused time with the equipment.
12. Please list an alternate contact who might be responsible for the system in case we are unable to reach you — see the form below.

Limitations

The borrower may not generate income as a result of providing NeurOptimal® sessions with this equipment unless explicitly discussed ahead of time with Whole Family Neurofeedback.

Care of Equipment

The equipment listed below is being rented out by Whole Family Neurofeedback and remains the property of Whole Family Neurofeedback. The borrower accepts personal responsibility for the care of the equipment at all times. The borrower will log in for a Zen Connect tech session at Whole Family Neurofeedback's request, if needed, to troubleshoot the system if problems occur. There will be no charge for this service. No alterations, work, or additions may be made to the computer at any time except by Zengar Institute technical staff. Should technical problems arise as a result of additional software or hardware being installed by the client, Zengar will restore the system to its original settings and the borrower will be charged at Zengar's usual billing rate for this service. In the event of damage, theft, or loss, Whole Family Neurofeedback must be notified immediately. Compensation for lost, damaged, or stolen equipment is the responsibility of the borrower. All systems are insured for most damage and theft.

Replacement value of each component: Microsoft surface pro with wireless keyboard: $2400, 1 ZAmp: $1900, Sensors: $125.

Addendum

Client may choose to rent the machine for additional months. Client will be billed on the first day of the next 28 day cycle. Please notify by email at least one week prior to due date if renting additional time.

I agree to the terms and conditions set forth above. Once we receive your signed contract and consent form, we'll send you a secure link to complete payment and keep a card on file for the rental period. By typing my name in the form below, I am signing and consenting to this contract.

Client Informed Consent

I understand that NeurOptimal® is not a medical treatment, device or methodology. It is not used to diagnose medical disorders nor is it used as a medical treatment for disorders and has not been approved for any medical purpose by the FDA, Health Canada or any other governing agency. While Zengar users may or may not be licensed health care practitioners, their use of NeurOptimal® is solely as a tool for brain training and optimization and not as a means of diagnosis or as a medical intervention.

I am satisfied with the information I have been provided (verbal, written or otherwise) by my trainer on the effects I can expect during my NeurOptimal® training and my questions have been answered to my satisfaction. I understand that it is not possible to predict what my central nervous system will do with the information it is offered and consequently there can be no guarantee as to the results of my training.

I agree to cease training if I am less than happy with the results I am getting. I understand NeurOptimal® is purely a source of information and does not direct the response of the central nervous system. Consequently I agree to not hold Zengar Institute Inc or any of its users and trainers responsible for a less than desired outcome or any outcome that may be considered negative.
